Suit brought against convenience store for alleged contamination

A couple who run a Scranton business have filed a lawsuit claiming their property values decreased because of contamination caused by a nearby convenience store.

George and Mary Weidow, who own a business at 1323 Providence Road, are bringing the suit against the Joe’s Kwik Marts company and three other oil and gas companies doing business as Joe’s Kwik Marts, claiming that gasoline products leaking from the 1327 Providence Road store’s underground storage tanks caused contamination on their property.

“The plaintiffs have been notified by the Pennsylvania Department of Environmental Protection that their property … has been infiltrated by gasoline products … released from an underground storage tank of the Defendants,” the suit claims.

The state drilled a well on the property of Mr. and Mrs. Weidow to confirm the contamination, said attorney Michael Roth, who is representing the couple along with attorney Timothy Lenahan.

Mr. and Mrs. Weidow are seeking compensatory damages for loss in property value, as well as the costs of environmental sampling, monitoring and analysis, the cost of an exposure assessment and the costs of repairing or replacing property damaged by the contamination.

Attempts to reach Joe’s Kwik Marts officials for comment were not successful Thursday.
