Abengoa Bioenergy, which owns an ethanol plant in Colwich, is suing a contractor over a 2009 industrial accident.
In a suit filed last week, Abengoa said that it seeks more than $3.5 million from Faber Burner Co. of Lock Haven, Pa.
Abengoa bought a burner and control system from Faber to be used in ethanol production.
In April 2009, Faber technicians serviced the system. The day after they left, on April 18, the boiler controlled by the burner system “experienced a catastrophic failure as a result of an explosion in the fire box.”
The plant sustained damage that has yet to be fully determined, but at least $3.5 million, according to the suit.
Abengoa maintains that Faber was negligent in designing, building and installing the burner.
Representatives from Abengoa and Faber could not be reached for comment.
Abengoa has owned the 25-million-gallon-a-year ethanol plant since buying it from High Plains in 2002.
Abengoa, based in Spain, develops projects in the areas of solar energy, bioenergy, waste recycling and management, information technology, and engineering and industrial construction.
