Company that rebuilt M-53 must answer lawsuit

The company the Michigan Department of Transportation contracted to perform last year’s M-53 reconstruction project in Bad Axe has less than two weeks to respond to a lawsuit that was filed by more than 20 residents who had sewage flood their basements in July.
According to court documents, Pamar Enterprises Inc., a Michigan corporation, previously failed to answer the lawsuit, an order entering the company into default was made. However, court officials told the Tribune on Friday that both parties agreed to have that motion set aside, and Pamar has two weeks to file its answer to the lawsuit.
The lawsuit, which was filed in April, states that “as a direct and proximate cause of Defendant Pamar’s breach of its duty, plaintiffs’ sustained damage, including but not limited to, the introduction of raw sewage into their houses, the loss and destruction of property, both real and personal, humiliation, emotional loss and pain and suffering.”
The lawsuit claims the plaintiffs, all of whom reside within and/or own property in Bad Axe, sustained damages collectively exceeding $600,000.
The plaintiffs are Robert Tschirhart, Misty A. Prill, Ceci Pratt, Leland Pratt, Madalyn O’Connor, Chrisopher A. Natzel, Shirley A. Murray, Marilyn R. McAllister, Janel Mayworm, Dustin R. Maurer, Ann Minnick Massey, Dolores Leonard, Michael J. Kohler, Kenneth A. Hacker Sr., Esther Evans, Samuel M. Gage, Ruth Ann Etzler, Leonard J. Etzler, William H. Eppenbrock, Peter B. Capling, Sue Capling, Robert R. Bechtel and A. James Braun.
