Construction Management Standard of Care

As was reported in the November 14, 2012 issue of DelmarvaNow.com (http://tinyurl.com/b4bmuon) a jury has ruled that the construction manager hired to oversee and manage the construction of the bungled sewage treatment plant upgrades in Salisbury, MD must return $2.1 million of what it had already been paid for the work. The six-person jury deliberated for 6-1/2 hours. Pending an appeal, the ruling marked the end of the city’s two-year quest to hold the various companies involved in the upgrades, financially responsible for their failure. Robert Wilkinson of Nautilus was the lead testifying construction management standard of care expert to the Plaintiff’s legal team, assisting in obtaining this significant jury verdict. This verdict resulted in a judgment for the Plaintiff in their recovering approximately 77% of the construction management fees which had been paid.
