THE CLAIM
An XL insured purchased a Pollution and Remediation Legal Liability Policy for a real estate portfolio comprised of commercial sites. At one insured location, there was an incident involving a mechanical failure in the control cabinet of an elevator car. The mechanical failure of the elevator car caused a capacitor to explode, sending polychlorinated biphenyls (PCB) laden oil into the immediate vicinity. One commercial tenant was evacuated for a short time, but no injuries were reported.
THE RESPONSE
XL’s environmental claims counsel and a technical consultant retained an emergency response contractor and a remediation contractor to handle clean-up activities required from the release of PCBs. The cleanup was completed and the area was returned to use. XL worked closely with the insured during this process and monitored the clean-up activities.
THE SOLUTION
The insured’s Pollution and Remediation Legal Liability Policy paid in excess of $100,000. Remediation activities were completed quickly and the insured had the full support of XL throughout the process.
