Environmental Consultant – Permitting Services

An environmental consultant was contracted to provide environmental permitting services for its client, a manufacturer of plastics. The client planned to construct a new facility and the consultant was retained to assist obtaining the required air permit. The permit was issued and the construction of the facility was completed.
Nearly four years later, the regulatory agency alleged the consultant had underestimated emissions from the facility by a factor of 100x. As a consequence of the error, the client was fined by the regulatory agency in the low six figures. The client sued the consultant, demanding payment for its costs, including attorney’s fees.
