Environmental Consultant – Site Assessments

An environmental consultant has hired to perform Phase I/Phase II environmental site assessments for a prospective commercial property seller. Following the purchase of the property, a suit was filed by the buyer against the consultant alleging they negligently prepared the site assessments. The suit alleged the assessments were negligently prepared and misleading to the extent that the reports failed to advise of the extent of the contamination on the property and had the buyer been advised of the extent of the contamination, they would not have purchased the property. Damages were in the high six figures.
