A landfill was issued violations by a state regulatory authority for an alleged failure to maintain their landfill gas collection system. The landfill also received odor complaints from neighboring residents. A lawsuit was filed by a neighboring shopping center, claiming a significant loss of business due to customer odor complaints. A second lawsuit was filed by the town alleging the odors had detrimentally affected a newly planned residential/commercial development. The suit was settled in the low seven figures and the Facility’s Site Specific Pollution Liability Policy responded to the defense and property damage claims.
