John Weiss in May 2013 sold his Volvo dealership to the Dean Team.
The Dean Team, though, also wanted ownership of the property, at 7700 Manchester Road in Brentwood.
In April 2014, Dean Team Brentwood Volvo LLC exercised its option to purchase the property for $1.5 million from its owner, Twin Realty Company, a partnership composed of trusts under the wills of Suzanne Feld Zalk and Elaine Feld Stern.
Environmental problems have prevented the completion of the sale, according to a lawsuit filed Tuesday in St. Louis County Circuit Court. According to the complaint, filed by Armstrong Teasdale attorney Matthew Reh on behalf of Twin Realty Company, Dean Team contends Twin Realty Company is obligated to remove an underground storage tank and hydraulic lifts, interior drains and oil traps. Dean Team also wants Twin Realty Company to conduct sampling and excavate 200 tons of soil near the former site of two underground storage tanks removed in the early 1990s, according to the complaint.
Twin Realty Company has agreed only to close and remove the existing storage tank, the complaint says, and no sampling is needed because it has already been done.
Patrick Dean, William Dean and Mary Jinkerson own five St. Louis-area Dean Team dealerships.
Patrick Dean did not immediately respond to a request for comment.
