‘Failure to mitigate damages’ alleged by Turn Key Construction as firm fights school district lawsuit over Peak Innovation Center

A contractor facing a lawsuit from Fort Smith Public Schools denies responsibility for costly issues related to drainage at the Peak Innovation Center and asserts it raised concerns during construction.

In the May 1 civil suit, the School District claims breach of contract and negligence/professional negligence against Turn Key Construction Management, Inc., which has offices in Fort Smith and Bentonville. Read more.
