New Day’s broker partner sought our help to compete on a new opportunity.  The insured was a $40,000,000 commercial contractor performing at-risk construction management and design/build services.  New Day structured a Professional Liability (PL)/Contractor’s Pollution Liability (CPL) program that included coverages that the incumbent broker did not include, such as Mitigation of Damages coverage, Emergency Response Cost coverage, broader definition of pollution conditions (including bacterial matter, not just legionella), and no exclusion for naturally occurring substances like silica, lead, mercury, asbestos, etc., as well as blanket Non-Owned Disposal Site Coverage.  Although the premium on the combined PL/CPL program was only $23,000 , New Day was successful in constructing a  program that competed with the incumbent carrier’s price and ultimately won the business.
