New Day Successfully Places OPPI Policy
New Day successfully placed an Owner’s Protective Professional Indemnity (OPPI) policy for a public power company, who is building a $360 million power plant consisting of four natural gas turbines. The Insured is the owner and construction manager of the design/build project, with a nationally-respected lead design firm charged with all design tasks. The General Contractor is yet to be named. Complicating coverage were two limitations of liability within the contract with the lead design firm. One limited the demolition and reconstruction of portions of the project because of design errors or omissions. New Day participated in conference calls and negotiated between the Insured and the carrier to minimize the cost impact of covering excess of the limitation of liability, which was less than the negotiated minimal insurance requirement. The policy was placed with $10 million limits, with the retroactive date set back to the start of design. Construction is set to start in 2013.
