ABC Property Management, a company that manages several apartment complexes, hired an employee named Mark to handle tenant applications and leasing processes. Mark was responsible for screening potential tenants, conducting background checks, and approving leases.
A prospective tenant, Sarah, applied for an apartment in one of the complexes managed by ABC Property Management. Sarah claimed she met all of the qualifications and had a good credit history, but Mark denied her application. Sarah filed a complaint with the local Fair Housing Authority and subsequently filed a lawsuit against ABC Property Management for discrimination in housing. Sarah’s claim alleged that ABC Property Management, through its employee Mark, engaged in discriminatory practices in violation of the Fair Housing Act by denying her application based on her ethnicity.
