Rectification Claim Example – Gas Station & Convenience Store

The insured was retained to provide surveying and staking services in connection with the construction of a gas station and convenience store, which included a canopy over the gas pumps. During construction, it became apparent that the insured staked the canopy columns incorrectly, resulting in an additional six feet of space between the canopy and the convenience store building. This gap exceeded the dimensions allowed by the gas station branding and building requirements. This required additional curbing being poured to meet the gas station requirements. The insured reported the matter on September 9, 2024 as a Design Error Circumstance and request for Rectification Expense. Repairs were made and an executed release agreement was obtained from the project owner. The insured paid the Rectification Expense directly, then submitted proof of payment on November 4, 2024. The reimbursement check was issued to the insured the same day.
