Rectification Claim Example – Ice Hockey Facility

The insured was retained to provide architectural design services for the renovation of a professional ice hockey training facility. Following construction, the owner of the facility reported that the players were experiencing issues with dulled skate blades, which were attributed to the rubberized flooring material that the insured specified for the hallway and locker room areas. The insured investigated the issue and learned from the manufacturer that the flooring specified by the insured was not rated for use with ice skates and that use of the flooring with ice skates would void any manufacturer’s warranty. The floors had to be replaced. The insured reported the matter on May 9, 2025 as a Design Error Circumstance and request for Rectification Expense. A signed release agreement has been received, and at this time we await proof of payment by the insured to issue the reimbursement check.
