Rectification Claim Example – University Parking Lot

The Insured provided surveying and civil engineering services for a community college, which included including a grading plan and construction staking for the parking lot. During the final project walkthrough, significant ponding was discovered in the parking lot, especially in the accessibility parking spaces. The ponding raised concerns about freezing of the ponding areas during the winter months, causing a safety hazard. An as-built survey identified low points throughout the parking lot that were holding water and creating dangerous ice patches. The Insured reported the issue to The Hartford on May 24, 2022, noting there appeared to be a surveying/staking error which led to the ponding issues. The Hartford accepted the notice as a request for Rectification Expense under the Policy. The Insured received repair requests, and after obtaining approval to proceed with corrective work, the Insured paid for the repairs and submitted documentation to The Hartford for reimbursement in excess of the Retention. Upon receipt of a remedial plan and the requested documentation, The Hartford reimbursed the Insured for the expenses incurred above the Retention on October 13, 2022 and the file was closed without a Claim being made on the same day. Resolution in this manner assisted the Insured with resolving the issue without a claim for delay or other consequential damages, and it helped the Insured maintain its relationship with its client.
