Claims of any kind can have a substantial negative impact on a construction project. The costs associated with claims include not only the dispute resolution costs (e.g., attorneys’ and consultants’ fees) but also will ultimately result in one or more parties involved in the claim paying for additional project costs it did not anticipate. Claims between a contractor and its lead design firm on a design-build project, especially when arising early in the project schedule, add a different and possibly more debilitating cost—deterioration of the contractor-designer relationship. Taking proactive measures and implementing strategies to reduce or eliminate claims on design-build projects—as early as the date the request for proposal is issued—should be a high priority on design-build projects. ¹ Read more.
