New Day successfully secured Professional and Pollution Liability coverage for an At-Risk Construction Management firm that was non-renewed by their professional liability carrier.  The firm had been non-renewed as a result of adverse claims experience, with two large claims reported over the past 5 years that had seen some negative development.  New Day sought out options and was not only successful in enhancing the coverage compared to the past year’s policy, but also negotiated a flat premium based on the prior year premium.  New Day enhancements included: broadened definition of professional services and filling holes in the expiring policy with coverage for certain services rendered day-in and day-out by the insured, including the removal of job safety, cost estimating, temporary structures and construction means and methods exclusionary language.
